FaZe Clan vs. Tfue lawsuit has court date set for November 8

After the controversy between North American esports organization FaZe Clan and professional Fortnite player Turner “Tfue” Tenney, a major court hearing date has been set for Nov. 8. This hearing will determine the validity of one of FaZe Clan’s main arguing points — whether California or New York is the valid jurisdiction for the case, according to a report.

FaZe Clan vs. Tfue

The California court will rule on the location for the case’s jurisdiction. Tfue and his legal team have argued that his contract is invalid. This is because the state of California has a Talent Agency Act. However, FaZe Clan does not have a license to operate as a talent agency. Since the contract and other business was done with Tfue in California, the argument is that the Talent Agency Act should be applied. 

On the other hand, FaZe Clan has argued that their company is incorporated in Delaware. Their contract reportedly notes that the jurisdiction would apply to New York. Because of this, FaZe Clan has asked the California court to dismiss the lawsuit under forum non conveniens. However, Tfue’s legal team responded to this with the argument that the case should be dismissed under the Colorado River Abstention Doctrine.

The conflict between the organization and the player began when the former FaZe Clan Fortnite professional player came out with a case against his organization. Tfue did not like the specifics of his contract and wanted to keep the totality of his revenue stream. The organization argued that they had signed Tfue when he had very little popularity and grew him to his current size.
